Breaking News: Safe Work Australia Introduces 4 Key Principles for Work Health and Safety Duties

Safe Work Australia has released 4 key Principles for Work Health and Safety Duties (WHS) to ensure workplace safety, promote practices to safeguard workers’ health and distribute work in a collaborative format. The Australian statutory agency considers the safety and well-being of workers and all individuals impacted by the tasks at hand to be of utmost importance.

The principles of the Model WHS Act apply to all work health and safety duties as highlighted in sections 13-17, and the PCBU should take charge and ensure compliance with these principles fully.

These principles apply to various responsibilities of a PCBU, officer, and worker. They also cover duties related to incident notification, consultation, and health and safety obligations under the model WHS regulations.

4 Key Principles – A Brief Introduction

1. WHS Duties are Non-transferable:

According to this principle, one cannot delegate duties to someone else as a duty holder. Additionally, it is worth mentioning that any contractual provision whose objective is to diminish the duty holder’s liability will be considered null and void.

Collaboration is essential for task completion. Individuals must work together and reach a consensus to avoid duplication of efforts and ensure a smooth and timely task accomplishment.

2. An Individual can have Multiple Duties:

A person can have multiple responsibilities simultaneously. For instance, someone could be both a worker and an officer or a worker and a PCBU if they work as an independent contractor.

3. Multiple Individuals can Simultaneously have Same Duty:

When multiple individuals share a duty, they are expected to fulfil their obligation to the required standard. When several people are responsible for a particular matter, they are personally accountable for their duties. They must execute them to the best of their ability to affect or manage the issue. Additionally, these duty holders must collaborate, coordinate, and consult with one another.

4. Management of Risks

As a responsible duty holder, it is imperative to effectively manage health and safety risks by entirely eliminating them whenever feasible and minimizing them when necessary. This should be accomplished reasonably and practically, which is essential to ensuring the well-being of all involved.

“Reasonably practicable” refers to the concept of taking all feasible measures to ensure the safety of individuals in the workplace.

Industries covered by the New WHS Principles

The new principles for workplace health and safety can impact various industries across the board. While the specific impact and implementation may vary based on the type of industry, the principles generally aim to ensure the well-being and safety of workers. Here are some industries that are likely to be influenced by these principles:
